The HC comes to Louis Vuitton’s aid, enjoining the ClubFactory portal from selling products that infringe on the trademark.

The Delhi High Court has granted a protective order against ‘Club Factory’ in the trademark infringement suit filed by Louis Vuitton, providing relief to an iconic luxury fashion company.
The China-based platform that was prohibited by an Indian government midst a pandemic from selling, distributing, and sale direct or indirect any products including surgical masks, etc. with certified marks of Louis Vuitton over its portal or indeed any portal operating with them has been immediately and restricted by Justice Pratibha M. Singh’s single-judge bench.
Despite all Defendants’ commitment that, after being alerted, the Addresses upon which infringing goods are hoisted would’ve been removed by the order being issued on July 3, 2020. The URLs are merely covered up and remained to stay on Defendant’s website.
After contesting the case for multiple hearings following the GoI’s directive, the defendants have stopped attending court. In response, the Court ordered the Department of Telecommunications (DoT) and the Ministry of Electronics and Information Technology (MeiTY) to issue instructions to all internet service providers to block the website www.clubfactory.com, making it inaccessible via VPN and other platforms.
