lawyers to submit all the information on time and not create unnecessary hurdles in granting IPRs: Piyush Goyal
Piyush Goyal, minister of commerce and industry, encouraged applicants for intellectual property rights on Saturday to advise their attorneys to submit all the essential material on time and avoid putting unnecessary obstacles in the way of IPR grants. A developer or inventor of a distinctive product may be granted intellectual property rights (IPRs) under a law to safeguard their innovation for a predetermined amount of time. Patents, trademarks, and geographical indications are some of these rights.
“Please request that your attorneys not seek adjournments. We’re intending to amend that regulation soon to make it difficult for people who keep requesting for postponements or don’t turn in their data on time. We can even reject an application and send it back if someone doesn’t submit the data within a fair amount of time. Please respond promptly with the requested details “said Goyal.
He was speaking to attendees of the Department for the Promotion of Industry and Internal Trade’s National IP Conference and Awards Function (DPIIT). The minister claimed that measures must be used to punish those who raise objections frequently without providing any real justification.
“It’s high time to put an end to such tactics, he continued, noting that it was simple to object to and make it difficult for someone to obtain an IP. But I would kindly request that anyone working on the legal side of the topic do it with some degree of compassion “he added.
Let’s avoid joining the ecosystem that constantly seeks to undermine anything positive taking place in the nation if someone has actually done some good research work that merits acknowledgment or to be granted a patent, the minister continued.
“According to what I’ve been told, complaints are frequently brought up up until the day a patent is actually issued in order to delay its issuance. Hearing adjournments are frequently requested, but this just serves to slow down the process overall “explained he.
The minister requested that an assessment be conducted by the Controller General of Patents, Designs, and Trade Marks (CGPDTM).
As we finalise our alterations, he said, “We are now in the process of redrafting the statute. Please provide your suggestions.”
Additionally, he offered a prize of Rs 11 lakh for software development that would speed up the construction of GIs and designs.
