HC: ANINEWSINDIA is infringing on the ANI trademark, and a permanent injunction order has been issued

In a trademark dilution petition lodged by news agency ‘ANI,’ the High Court Of Delhi had made the decision to award a permanent injunction on ‘ANINEWSINDIA.’
The defendants were utilizing ANI not only as a trademark and also as a domain name/website, according to Justice Pratibha M. Singh’s single-judge panel.
The plaintiff claimed that its trademark ANI has been an integral element of its registered domains www.aniin.com or www.aninews.in since 1999 and it has been utilized continuously since that time. Plaintiff is said to have a sizable online presence, with much more than 6.3 million followers on Twitter.
Due to Plaintiff’s past acquisition or registration of the trademark ANI, Plaintiff’s entitlement to the trademark is conclusively proven. The Court noted that Defendants Nos. 1 and 2 need to use the same comparable mark for news & media-related solutions.
“Defendant created a website called www.aninewsindia.com and claimed to be ‘ANINEWSINDIA.’ The aforementioned domain is a media site. As a result, the Defendants were already using ANI not just as a trademark, or even as a domain name as well as website.”
The Court noted that such services provided by both entities are identical, which is sure to cause confusion.
